Motion to dismiss assault charges denied; Acupuncturist accused of assaults at area centers
A judge has denied a motion to dismiss five counts of sex assault against an acupuncturist who allegedly inappropriately touched women in the Cities of Pewaukee and Delafield.

Waukesha - A judge has denied a motion to dismiss five counts of sex assault against an acupuncturist who allegedly inappropriately touched women in the Cities of Pewaukee and Delafield. Samy A. Elawaday, 63, of Wauwatosa was charged March 12 in Waukesha County Circuit Court with nine misdemeanor counts of fourth-degree sexual assault. Elawaday is accused of inappropriately touching women's breasts at the Oriental Wellness Center, W240 N3425 Pewaukee Road, City of Pewaukee and the Lake Country Health Center, 524 Milwaukee St., City of Delafield. Five of the counts are related to incidents at the Pewaukee center and four at the Delafield center. The incidents are alleged to have occurred between September 2007 and January.
Elawaday's attorney, Paul Bucher, sought to have the five counts relating to the incidents in Pewaukee dismissed because prosecutors did not allege in those counts that Elawady touched the women's breast for sexual gratification. Judge Ralph Ramirez ruled last Tuesday that he would not dismiss the counts, according to court records.
According to the criminal complaint, after treating the women, Elawady would rub down the women and while doing so would massage their breasts.
One of the alleged victims asked an acupuncturist if such actions were normal and was told "absolutely not," the complaint said. The acupuncturist said Elawady teaches acupuncture and "she personally heard Elawady refer to the breast area as jail number one and the genital area as jail number two," the complaint said.
The acupuncturist told police "any rubbing or massaging of the breasts would be highly inappropriate and unethical," the complaint said.
Elawady has denied the allegations. A trial is set for July.
